  7. You agree to be punctual for all appointments with DrugEval.com staff. Should you be unable to attend a scheduled appointment, it is imperative that you inform us promptly. If you miss your initial appointment, you may reschedule the session once. However, failure to attend the second appointment will necessitate restarting the process with a new payment, and you will forfeit your eligibility for a refund due to non-participation.

TO THE EXTENT PERMITTED BY LAW AND SUBJECT TO THIS SECTION, THE TOTAL LIABILITY OF DRUGEVAL.COM AND ITS RELATED PERSONS FOR ANY CLAIMS UNDER THESE TERMS SHALL NOT EXCEED U.S. ONE HUNDRED DOLLARS ($100.00 USD). NOTE THAT SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS OF LIABILITY OR MAY PLACE LIMITATIONS ON OUR ABILITY TO LIMIT OUR LIABILITY TO YOU, SO THE FOREGOING LIMITATION MAY NOT APPLY TO YOU.

Indemnification

You agree to indemnify, defend, and hold DrugEval.com and any of its related persons, licensors, and suppliers harmless from and against any and all third-party claims, demands, liabilities, costs, or expenses, including attorneys’ fees and costs, arising from or related to:

Governing Law; Dispute Resolution; Arbitration; Class Action Waiver

Governing Law. DrugEval.com operates from the United States and is subject to the laws and jurisdiction of the United States. These Terms will be governed by the laws of the State of Georgia without regard to conflicts of law principles.

Arbitration Agreement. You and DrugEval.com agree that all claims and disputes arising from or related to your use of our Platform or these Terms shall be resolved through binding arbitration, except for disputes that can be resolved in small claims court, disputes related to copyrights, trademarks, trade names, logos, trade secrets, or patents, or disputes pending at the time you first agree to these Terms. Arbitration will take place in Atlanta, Georgia.

Waiver of Jury Trial. IF ARBITRATION IS NOT PERMITTED BY APPLICABLE LAW, YOU AND DRUGEVAL.COM WAIVE THE RIGHT TO A TRIAL BY JUDGE OR JURY. Instead, claims and disputes will be resolved through arbitration, which is typically more efficient and less costly than court proceedings. The arbitrator’s decision will be binding and may be entered as a judgment in court.

No Class Arbitrations, Class Actions, or Representative Actions. ALL CLAIMS AND DISPUTES MUST BE ARBITRATED OR LITIGATED ON AN INDIVIDUAL BASIS, NOT AS PART OF A CLASS ACTION OR REPRESENTATIVE ACTION. THE ARBITRATOR MAY NOT CONSOLIDATE CLAIMS OR PRESIDE OVER CLASS OR REPRESENTATIVE PROCEEDINGS. ANY RELIEF AWARDED CAN ONLY BENEFIT THE INDIVIDUAL SEEKING RELIEF AND CANNOT AFFECT OTHER USERS OF DRUGEVAL.COM.

Arbitration Rules. The Federal Arbitration Act governs this dispute resolution provision. Arbitration will be conducted by the American Arbitration Association (“AAA”) and will follow the AAA Consumer Arbitration Rules. Details and forms can be found at www.adr.org.

Miscellaneous

These Terms constitute the entire agreement between you and DrugEval.com regarding your use of the Website. If any provision of these Terms is deemed invalid, then that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.
